1. Price and Ordering
1.1
The price payable for Products is displayed on the Company’s website, online trading platforms, or at the Company’s premises. Prices may change without notice but will always be confirmed at the time the Customer places their order.
Certain new motorcycles may be displayed as “+ OTR (On The Road)”, meaning additional costs may apply in order to make the motorcycle legally compliant for road use. These costs may include, but are not limited to:
-
DVLA registration fee
-
road tax
-
number plates
-
pre-delivery inspection
1.2
An order received from a Customer shall not be considered binding until a deposit or full payment has been received and accepted by the Company.
Where a deposit is taken, it will typically secure the Product for a period of 7 days, unless otherwise agreed in writing at the time of purchase.
Failure to pay the remaining balance within the agreed timeframe may result in:
-
cancellation of the order
-
the Product being returned for sale
-
the deposit being retained by the Company
This clause does not affect the Customer’s statutory rights.
1.3
The Company reserves the right to withdraw any Product from sale or cancel an order at its discretion. This may occur where:
-
a pricing error has occurred
-
the Product is no longer available
-
the Company is unable to supply the Product
Where the Company cancels an order, any payment received will be refunded in full.
1.4
Title to the goods shall only pass to the Customer once payment in full has been received, including all applicable taxes, delivery charges, and fees.
The Company reserves the right to repossess Products in the Customer’s possession where payment has not been received in full.
1.5
The Company accepts the following methods of payment:

cleared bank transfer (BACS)
-
approved finance agreements
-
debit cards
-
credit cards
-
cleared cheques
-
The Company reserves the right to request proof of identity or verification of payment details for fraud prevention.
Where the Company incurs merchant processing fees for certain card payments, a reasonable handling fee may apply, particularly for high-value transactions.
1.6
Where Products are paid for in advance and subsequently become unavailable or delayed, the Customer will be notified and given the option to:
-
accept a revised delivery timeframe, or
-
cancel the order for a full refund.

1.7
Products specifically ordered or sourced on behalf of a Customer may require full or partial payment in advance and may be non-refundable, unless otherwise agreed in writing.
Such Products will normally be held for 7 days pending collection.
Failure to collect within this timeframe may result in the Product being returned to sale.
2. Delivery and Title
2.1
Where delivery is offered, any quoted delivery date is an estimate only and cannot be guaranteed.
The Company shall not be held liable for delays caused by circumstances outside its reasonable control.
2.2
The Company reserves the right to use approved third-party delivery providers where delivery cannot be completed using Company vehicles.
2.3
If the Customer fails to receive or collect the Product on the agreed date, the Company reserves the right to:
-
store the Product at the Customer’s risk
-
charge reasonable storage costs
-
charge additional delivery costs if redelivery is required.
2.4
Risk in the Product shall pass to the Customer upon delivery or collection, whichever occurs first.
3. Back Orders
3.1
If Products ordered by the Customer are not in stock, the Company may place the Product on back order and provide an estimated delivery date.
The Customer will be given the option to cancel the order if the revised delivery date is not acceptable.
This clause does not apply where a motorcycle has already been registered in the Customer’s name.
4. Guarantees and Warranties
4.1
All Products supplied are subject to the Customer’s statutory rights under the Consumer Rights Act 2015.
4.2
Used motorcycles supplied by the Company typically include a 30-day or 3,000-mile warranty, whichever occurs first, unless otherwise stated in writing at the time of sale.
4.3
The Company reserves the right to inspect and repair any fault in the first instance before offering replacement or refund.
4.4
Customers must notify the Company of warranty claims by contacting:

Unless otherwise agreed, the Customer will be responsible for returning the Product to the Company for inspection.
4.6
Warranty may be void where:
-
modifications have been made to the Product
-
servicing requirements have not been followed
-
the fault is caused by misuse, accident or neglect.

4.7
Where applicable, manufacturer warranties will supersede the Company warranty.
5. Liability
5.1
Customers should inspect Products immediately upon delivery or collection and report any damage or defect within 24 hours.
5.2
Returned Products will be inspected by the Company and, where a defect is confirmed, the Company will offer:
-
repair
-
replacement
-
or another appropriate remedy.
5.3
Where no defect is identified following inspection, the Product may be returned to the Customer and the Customer may be responsible for transport or inspection costs.
5.4
The Company’s total liability for any claim shall not exceed the purchase price of the Product.
5.5
The Company shall not be liable for indirect or consequential losses, including loss of profits or additional costs.
Nothing in these terms excludes liability for:
-
death or personal injury caused by negligence
-
fraud or fraudulent misrepresentation
-
statutory consumer rights.
6. Privacy Policy
6.1
Customer information will be processed in accordance with UK Data Protection legislation.
Information will only be shared where necessary for:
-
order fulfilment
-
delivery
-
finance applications
-
legal requirements.
7. Force Majeure
7.1
The Company shall not be liable for delays or failure caused by events outside its control including:
-
supply chain disruption
-
natural disasters
-
transport failure
-
labour disputes
-
government restrictions
8. Part Exchange Vehicles
8.1
Where a Customer offers a vehicle in part exchange:
-
the Customer confirms they are the legal owner
-
the vehicle must be free from finance or encumbrances, unless declared
-
the Company may revise the valuation if the condition differs from that described.
Where finance remains outstanding, the Company may settle the finance directly with the lender and deduct this amount from the agreed value.
9. Distance Selling Regulations
9.1
Where a purchase is made online, by phone, or without visiting the Company’s premises, the Customer may have the right to cancel the contract within 14 days under the Consumer Contracts Regulations 2013.
The cancellation period begins on the day the Customer receives the Product.
Where cancellation occurs:
-
the Product must be returned in the same condition
-
return costs may be the responsibility of the Customer
-
deductions may apply for use beyond reasonable inspection.
This clause does not apply to motorcycles registered in the Customer’s name or customised to order.
10. Vehicle Registration
10.1
Where a motorcycle is registered with the DVLA in the Customer’s name before collection or delivery, the motorcycle will be considered used for the purposes of resale and cancellation rights.
Once registration has taken place:
-
the motorcycle cannot be sold as new
-
cancellation may result in reasonable deductions for registration costs and depreciation.
11. General
11.1
If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force.
11.2
These Terms and Conditions shall be governed by the laws of England and Wales.
11.3
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11.4
Images displayed are for illustrative purposes only and the actual Product may vary.
12. Uncollected or Abandoned Vehicles
12.1 Where a Customer fails to collect a motorcycle or other Product within 14 days of being notified that the Product is ready for collection, the Company reserves the right to charge reasonable storage fees.
12.2 The Company will make reasonable attempts to contact the Customer using the contact details provided at the time of purchase or booking.
12.3 If the Product remains uncollected for a period of 60 days, the Company reserves the right to take reasonable steps to recover any outstanding costs including:
-
storage fees
-
repair costs
-
administrative costs
12.4 In circumstances where the Product remains uncollected for an extended period and the Customer cannot be contacted, the Company reserves the right, where permitted by law, to sell the Product to recover any outstanding costs.
12.5 Any remaining balance after such costs have been recovered will be held for the Customer for a reasonable period.
13. Finance Applications
13.1 Where the Customer applies for finance in connection with the purchase of a Product, the order shall remain conditional upon finance approval by the lender.
13.2 If finance is declined or the Customer chooses not to proceed with the finance agreement, the Company reserves the right to:
-
cancel the order, and
-
retain a reasonable portion of any deposit to cover administrative costs where the Product has been reserved or removed from sale.
14. Pre-Delivery Inspection
14.1 All motorcycles supplied by the Company will undergo a pre-delivery inspection (PDI) prior to handover to ensure they are safe and ready for use.
14.2 The Customer is responsible for ensuring that:
-
the motorcycle is properly insured prior to use
-
the motorcycle is used in accordance with all applicable road laws.
15. Test Rides and Demonstrations
Where the Company permits a Customer to test ride a motorcycle:
-
the Customer confirms they hold a valid licence for the motorcycle category
-
the Customer must comply with the Company’s insurance and safety requirements
-
the Customer accepts responsibility for any damage caused through negligence or misuse.
16. Product Specifications
Manufacturers may alter specifications, colours, or features of Products without prior notice.
The Company reserves the right to supply Products with minor specification changes that do not materially affect the performance or function of the Product.
